Title Company or Attorney Closing in Florida: What's the Difference?

Unlike a handful of other states, Florida closes most residential sales through title agencies rather than attorney-run escrow. Here is what each model means for you.

Two models, one very similar goal

When you buy or sell a home in Florida, a licensed professional makes sure the title is clean, the money moves correctly, and the deed and mortgage get recorded. In most Florida counties that professional is a title agency: an experienced closer plus a title insurance underwriter standing behind the search. In a few counties, closings happen through attorneys.

Both models reach the same finish line: a properly recorded closing. The practical differences are in who you deal with, what documents you see, and how the process is regulated.

What a title agency does

A title agency coordinates the entire closing: it orders the title search, issues the title insurance commitments and policies, collects the payoff statements from lenders, works with your mortgage company to fund the loan, and records the documents with the county. You sit at the table with a professional closer who has done this hundreds of times.

Because Florida title insurance rates are set by the state, the policy cost is essentially the same whichever agency you use; what varies is service and experience. For most residential transactions, the agency model is the efficient, mainstream choice.

When an attorney is the better call

Attorneys add value when a transaction is unusual: a boundary dispute, complicated estates or trusts, new construction contracts, or anything involving litigation risk. Some buyers simply want legal review of the contract and the closing documents, which is always an option and rarely a bad one.

What matters most is that you know which model your transaction will use before you are sitting at the table, and that you understand every document you sign. I make sure my clients are never meeting their closer for the first time at the closing table.
